Privacy Policy.

What we collect, why we collect it, who else sees it, and how to make us delete it. Short version: we collect very little, we never sell it, and you can ask us to erase it at any time.

Purpose of this policy.

Welcome to Daytime Design Co. LLC, a Minnesota limited liability company ("Company," "DDC," "we," "us," or "our"). We value your trust and are committed to protecting your personal information. This Privacy Policy ("Policy") explains how we collect, use, share, and protect your data when you visit www.daytimedesign.co and any related subpages (the "Website").

By accessing or using the Website, you agree to the practices described here. This Policy applies when you:

  • Visit or browse the Website.
  • Send us a message through the contact form or by email.
  • Subscribe to our newsletter or other email communications.
  • Interact with our content or ads on third-party platforms, including Instagram, LinkedIn, Pinterest, and Facebook.

This Policy does not cover data collected offline, data collected by third-party websites or platforms we link to, or client project data governed by a separate signed services agreement.

Age requirement.

We do not knowingly collect or solicit personal information from anyone under the age of 16. If you are under 16, please do not submit any personal information to us. If we learn that we have inadvertently collected personal information from someone under 16, we will delete it promptly. If you believe we have collected such information, contact us at hello@daytimedesign.co.

Information we collect.

We may collect the following categories of personal information:

  • Personal identifiers. Name, email address, business or brand name, and any other details you choose to include in a message to us.
  • Project information. What you are looking for, timeline, budget range, and links you share, when you submit an enquiry.
  • Geolocation data. IP address and approximate location derived from it.
  • Internet and device activity. Browser type, operating system, device type, referring page, and how you move through the Website.
  • Media. Any files, images, or documents you choose to send us.

We do not collect payment or financial information through this Website. Invoicing and payment for design services happen outside the Website through third-party processors, under a separate services agreement.

We do not intentionally collect sensitive personal information, including data revealing racial or ethnic origin, religious beliefs, health conditions, precise geolocation, or biometric data. Please do not send it to us.

Where it comes from.

Directly from you

When you fill in the contact form, subscribe to the newsletter, reply to an email, or send us files.

Automatically

Through cookies and similar technologies when you browse the Website, and through our hosting provider's standard server logs.

From third parties

  • Hosting and form handling. Our host processes form submissions and server logs on our behalf.
  • Analytics providers. We may use tools such as Google Analytics to understand traffic and how the Website is used.
  • Email marketing platforms. If you subscribe, your email address is stored and processed by our email service provider.
  • Social media platforms. If you interact with our content or ads on Instagram, LinkedIn, Pinterest, or Facebook, those platforms may share aggregate engagement information with us.

Cookies and tracking.

A cookie is a small text file a website stores in your browser. We use cookies and similar technologies, including pixels and web beacons, to:

  • Remember your preferences, including your cookie choice on this Website.
  • Understand how visitors find and move through the Website.
  • Measure whether our social content and ads are working.

The categories we use

  • Strictly necessary. Required for the Website to function, including remembering that you have responded to the cookie notice. These cannot be switched off.
  • Analytics. Aggregate measurement of traffic and page performance.
  • Marketing. Where used, these help us measure and target our own advertising on third-party platforms.

Your choices

When you first arrive, we show a cookie notice with a clear decline option. Declining is a real choice and nothing on the Website breaks if you use it. You can change your mind at any time using the Cookie Preferences link, also available in the footer of every page.

You can also control cookies through your browser settings, and you can opt out of interest-based advertising through the Network Advertising Initiative at optout.networkadvertising.org. Disabling cookies entirely may affect how some features behave.

We allow a limited number of third-party cookies for analytics and advertising measurement. Those providers may collect your IP address, device information, and browsing behavior on this Website. We do not run affiliate links or affiliate tracking on this Website.

How we use it.

  • To reply to you. Answering enquiries, scoping projects, and following up on a conversation you started.
  • To send communications you asked for. Newsletters, studio updates, and occasional notes about new work, with an unsubscribe link in every send.
  • To run and improve the Website. Understanding what people read, what loads slowly, and what to build next.
  • To manage our client relationships. Keeping a record of enquiries and conversations so we do not ask you the same question twice.
  • To measure and optimise our own marketing. Understanding which content and ads bring the right people here.
  • To create testimonials or case studies. Only with your consent, and only using what you have agreed we can share.
  • To comply with legal obligations. Responding to lawful requests and enforcing our Terms of Use.

We do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.

Who we share it with.

  • Service providers. Trusted third parties that help us operate, including our web host and form processor, our email marketing platform, our analytics provider, and our business and file storage tools. They may process your information only to provide services to us.
  • Project partners. DDC is a small studio and brings in trusted specialist partners on some projects, such as developers or copywriters. Where a project requires it, we may share the information necessary to do the work, under confidentiality obligations.
  • Advertising and social platforms. We may share non-identifying information, such as device or engagement data, with platforms including Google, Meta, LinkedIn, and Pinterest to measure and target our own marketing.
  • Legal authorities. Where required by law, regulation, court order, subpoena, or governmental request, or to protect our legal rights, privacy, safety, or property, or that of others.
  • Corporate transactions. In a merger, acquisition, restructuring, or sale of assets, your information may transfer as part of the transaction. We will notify you of any significant change to how your information is handled.
  • Aggregated or de-identified data. Information that cannot reasonably be used to identify you may be shared freely for analytics, research, or marketing.
  • With your consent. In any other situation, only with your explicit permission.

Once your data is with a third-party provider, their own privacy practices apply. We encourage you to read the privacy policies of any third-party service you engage with.

We do not sell your data.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising in exchange for money.

One caveat worth stating plainly. Some privacy laws, including the California Consumer Privacy Act, define "sale" and "share" broadly enough that allowing third-party analytics or advertising cookies on a website can fall inside those definitions. If you would rather no third-party cookies run at all, decline in the cookie notice or use the Cookie Preferences link, and we will treat that as an opt-out of any such sharing.

To opt out of everything at once. Decline in the cookie notice and email hello@daytimedesign.co with the subject line "Privacy request." We will confirm and action it. No forms to chase, no dark patterns.

Content you submit.

If you send us content such as a testimonial, review, image, or other creative work through the Website or our social channels, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, distribute, and display that content for marketing and promotional purposes.

Please be aware that anything you share publicly is shared at your own risk. We cannot control how other users or third parties interact with content you post in public.

Your privacy rights.

Depending on where you live, you may have some or all of the following rights over your personal information. We extend these rights to everyone who asks, regardless of location.

  • Access. Confirm whether we process your personal data, and get a copy of it.
  • Correction. Have inaccurate or incomplete data corrected.
  • Deletion. Have your personal data deleted, subject to legal exceptions.
  • Portability. Receive your data in a portable, readable format.
  • Opt out. Opt out of targeted advertising, of any sale or sharing of your data, and of profiling.
  • Withdraw consent. Unsubscribe from marketing email at any time, using the link in any send or by emailing us.
  • Non-discrimination. Exercise any of these rights without being treated differently for it.

To exercise any of these rights, email hello@daytimedesign.co or use our contact form. We may need to ask a question or two to confirm who you are before we act, and we will not charge you for a reasonable request. We respond within 45 days, and will tell you if we need a single extension of up to 45 additional days.

If we decline your request, we will explain why, and you may appeal by replying to our response. If your appeal is denied, you may lodge a complaint with your state attorney general or applicable data protection authority.

Minnesota residents.

DDC is based in Minneapolis, Minnesota. The Minnesota Consumer Data Privacy Act (Minn. Stat. §§ 325M.10 to 325M.21), effective July 31, 2025, gives Minnesota consumers a set of rights over their personal data. As a small studio, we very likely fall below the Act's applicability thresholds. We honor these requests from Minnesota residents anyway.

In addition to the rights listed above, if you are a Minnesota resident you may:

  • Request a list of third parties. Ask us for a list of the specific third parties to which we have disclosed your personal data. If we do not hold that record in a form specific to you, we will provide a list of the third parties to which we have disclosed any consumer's personal data.
  • Question profiling. If your data were ever profiled in furtherance of a decision with legal or similarly significant effects, you may ask why, review the data used, have inaccurate data corrected, and have the decision reevaluated. We do not currently carry out this kind of profiling.
  • Appeal a refusal. If we refuse to act on a request, you may appeal by replying to our decision. We will respond within 45 days with a written explanation, and if we deny the appeal we will tell you how to file a complaint with the Minnesota Attorney General.

We also recognise universal opt-out preference signals, including Global Privacy Control, as a valid opt-out of targeted advertising and of any sale of personal data.

How long we keep it.

We keep your personal information only as long as we need it for the purpose it was collected. Enquiries that do not turn into projects are kept for up to two years so we have context if you come back. Newsletter subscriptions are kept until you unsubscribe. Client records are kept for as long as the relationship lasts and afterwards for the period required by tax, accounting, and legal obligations.

You can ask us to delete your data at any time, except where retention is required by law.

Data security.

We use reasonable and appropriate measures to protect your data from unauthorized access, loss, or misuse, including encrypted connections, access controls, and reputable third-party providers. No transmission of data over the internet is completely secure, so we cannot guarantee absolute security.

Do Not Track and GPC.

This Website recognises and responds to browser-initiated Global Privacy Control signals as an opt-out request. Support for Do Not Track headers is inconsistent across browsers and platforms, so we cannot guarantee that every form of tracking is disabled by one. For more on GPC, see globalprivacycontrol.org.

International transfers.

We are based in the United States and our service providers primarily operate here. If you are located outside the United States, your personal data may be transferred to and processed in the United States or other countries where those providers operate. Where required, we rely on appropriate safeguards such as standard contractual clauses to make those transfers lawful.

Changes to this policy.

We may update this Policy from time to time to reflect changes in our practices or our legal obligations. The "Last updated" date at the top of this page always reflects the current version. If we make a material change, we will post a notice on the Website and, where we hold your email address for that purpose, let you know by email. Continuing to use the Website after a change indicates your acceptance of the updated Policy.
